Eretz Israel is our unforgettable historic homeland...The Jews who will it shall achieve their State...And whatever we attempt there for our own benefit will redound mightily and beneficially to the good of all mankind. (Theodor Herzl, DerJudenstaat, 1896)

We offer peace and amity to all the neighbouring states and their peoples, and invite them to cooperate with the independent Jewish nation for the common good of all. The State of Israel is ready to contribute its full share to the peaceful progress and development of the Middle East.
(From Proclamation of the State of Israel, 5 Iyar 5708; 14 May 1948)

With a liberal democratic political system operating under the rule of law, a flourishing market economy producing technological innovation to the benefit of the wider world, and a population as educated and cultured as anywhere in Europe or North America, Israel is a normal Western country with a right to be treated as such in the community of nations.... For the global jihad, Israel may be the first objective. But it will not be the last. (Friends of Israel Initiative)

David Singer: Trump Reverses Obama-UN treachery on West Bank and East Jerusalem

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

President Trump’s decision to back Israel’s claims to sovereignty in the West Bank and Jerusalem has resurrected America’s commitment to the Jewish people made by President Bush and Congress in 2004 after that commitment had been subsequently repudiated by President Obama in the last month of his Presidency in December 2018.

Bush’s Congress-endorsed commitment was given to Israel in a letter from President Bush to then Israeli Prime Minister Ariel Sharon on 14 April 2004.  Bush confirmed that America regarded it as unrealistic to expect that the outcome of final status negotiations between Israel and the Palestinian Authority would see Israel withdraw from all of the West Bank and East Jerusalem.

President Bush’s commitment was overwhelmingly endorsed by Congress by 502 votes to 12.

Bush’s commitment procured Israel’s unilateral disengagement from Gaza and part of the West Bank in 2005 involving the forcible removal of 8000 Jews living there – a decision which has had disastrous consequences for both Israel’s and Gaza’s civilian populations after Hamas seized control of Gaza in 2007 from the Palestine Liberation Organization.

President Obama shredded this Bush Congress-endorsed commitment when he abstained – rather than vetoed Security Council Resolution 2334 on 23 December 2016, which declared:
 “the establishment by Israel of settlements in the Palestinian territory occupied since 1967, including East Jerusalem, has no legal validity and constitutes a flagrant violation under international law and a major obstacle to the achievement of the two-State solution and a just, lasting and comprehensive peace”
Secretary of State John Kerry offered this pathetic explanation on 28 December 2016 for Obama’s failure to veto Resolution 2234:
“the vote in the United Nations was about preserving the two-state solution.  That’s what we were standing up for: Israel’s future as a Jewish and democratic state, living side by side in peace and security with its neighbours.  That’s what we are trying to preserve for our sake and for theirs.”
Resolution 2334 however was asserting:
  • The West Bank and East Jerusalem were “Palestinian territory” and
  • 600,000 Jews currently living there had no legal entitlement to do so despite the League of Nations Mandate for Palestine and article 80 of the United Nations own Charter legally vesting that right in the Jewish people.
Obama and Kerry were knowingly complicit in America not vetoing this overtly-hostile anti-Jewish Security Council resolution. Obama invariably had vetoed similar Security Council resolutions during his eight years as president.

Obama’s then Secretary of State Hillary Clinton had misleadingly denied on 6 June 2009 that any such Bush-era commitment existed. Yet she had voted in the Senate to endorse Bush’s commitment on 24 June 2004 when a Senator.

Obama’s refusal to veto Resolution 2334 as he was exiting the White House – leaving this poisoned chalice behind for President Trump – was shameful.

Trump recognition of Israel’s right to retain portions of the West Bank and East Jerusalem has restored America’s reputation for honouring commitments made by its president and endorsed by its Congress.

Trump’s decision sends a clear message to the United Nations that it needs to act in accordance with its Charter if it is to have any influence or relevance in ending the Arab-Jewish conflict.

Trump has also put the Arab States on notice that America stands strong in its continuing support for Israel and its claims to sovereignty in the West Bank and East Jerusalem. The sooner the Arab States understand this change in America’s position post-Obama – the sooner Trump’s yet to be released “deal of the century” has a chance of succeeding.

Obama and the United Nations’ treacherous attempt to entrap Trump has spectacularly failed.

David Singer: Trump Recognizes Israeli Claims in West Bank and East Jerusalem

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

US Ambassador to Israel David Friedman has set a cat among the pigeons with his claim that:
“Under certain circumstances I think Israel has the right to retain some, but unlikely all, of the West Bank.”
Friedman clearly was speaking for the Trump administration – not just himself personally – when he continued:
“We really don’t have a view until we understand how much, on what terms, why does it make sense, why is it good for Israel, why is it good for the region, why does it not create more problems than it solves. These are all things that we’d want to understand, and I don’t want to prejudge.”
Friedman accused the Obama administration – which in the last month of Obama’s presidency  allowed passage of a United Nations resolution in December 2016 condemning Israeli settlements as a “flagrant violation” of international law – of giving credence to Palestinian Arab arguments “that the entire West Bank and East Jerusalem belong to them.”

Friedman asserted:
“Certainly Israel’s entitled to retain some portion of it”
Friedman was spot on.

The right of the Jewish people to reconstitute the Jewish National Home in at least some parts of the West Bank and East Jerusalem was recognised by:
  • the 1920 San Remo Conference
  • the 1920 Treaty of Sevres,
  • articles 6 and 25 of the 1922 League of Nations Mandate for Palestine (Mandate) and
  • article 80 of the 1945 United Nations Charter
Friedman’s criticism of the  United Nations attempt to subvert the Jewish people's legal rights created under the Mandate and preserved under the United Nations’ own Charter to “close settlement by Jewson the land including State lands and waste land not required for public purposes” located in the West Bank and East Jerusalem was justified and long overdue..

Friedman postulated:
“The absolute last thing the world needs is a failed Palestinian state between Israel and Jordan,”
He could have also added that:
  • Jordan is a Palestinian Arab state that has occupied 78% of the land comprised in the Mandate for Palestine since 1922
  • Redrawing the international boundary between Jordan and Israel in direct negotiations between those two states as successor States to the Mandate could see parts of the West Bank and East Jerusalem incorporated within each of these two existing states thereby eliminating any danger a failed third state would pose to their security and existence.
Interestingly – Friedman indicated that Trump’s long-awaited “deal of the century” might not even be released if Trump believed it would do more harm than good.

Friedman reportedly said the United States would coordinate closely with Jordan – which could face unrest among its large Palestinian population over a plan perceived as overly favourable to Israel.
 “We don’t want to make things worse. Our goal is not to show how smart we are at the expense of people’s safety.”
Trump has seemingly anointed Jordan to replace the rejectionist Palestine Liberation Organization as Israel’s negotiating partner on the future of the West Bank and East Jerusalem.

It now appears that Trump’s proposals will not see the light of day unless Trump receives an unqualified assurance from Jordan that it is willing to negotiate with Israel before the plan’s details are released.

Recognising Israel has claims in the West Bank and East Jerusalem sends a clear signal to Jordan and the rest of the Arab World that time is not on their side. The opportunity to yet again miss another opportunity to make peace looms large.

Trump has targeted the West Bank and East Jerusalem – as he already has in West Jerusalem and the Golan Heights – with amazing prescience.

David Singer: UN-Hamas Day of Infamy Mars Trump-Israel Day of Celebration

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

December 6, 2018, marks the day the United Nations General Assembly (“UNGA”) infamously sold its soul to evil by failing to agree on whether a resolution condemning Hamas and other militant groups in Gaza required two-thirds – or simple – majority vote.

December 6, 2018 also happened to be the first anniversary of President Trump’s announcement of America’s recognition of Jerusalem as Israel’s capital and the intended relocation of America’s Embassy from Tel Aviv to Jerusalem.

December 6, 2018 was also the fourth day of the eight-day Jewish festival of Hanukkah marking the rededication during the second century B.C. of the Second Temple in Jerusalem following the Jews uprising against their Greek-Syrian oppressors.

America had submitted draft resolution A/73/L.42 (“L. 42”)to the UNGA on 29 November 2018:
  • Condemning Hamas for repeatedly firing rockets into Israel and for inciting violence, thereby putting civilians at risk;
  • Demanding that Hamas and other militant actors, including Palestinian Islamic Jihad, cease all provocative actions and violent activity, including by using airborne incendiary devices;
  • Condemning the use of resources by Hamas in Gaza to construct military infrastructure, including tunnels to infiltrate Israel and equipment to launch rockets into civilian areas, when such resources could be used to address the critical needs of the civilian population;
The UN’s Press Release sums up what occurred when the draft resolution came to a vote on 6 December:
“The representative of Kuwait, speaking on behalf of the Arab Group, said the situation in the Middle East is directly linked to international peace and security.  He condemned Israeli policies that violate international humanitarian law and the Charter of the United Nations and requested a vote to apply the two‑thirds majority rule for the adoption of draft “L.42”.
The representative of the United States said a simple majority is required for adoption of the resolution.  She called for fairness in the United Nations and said action on the draft was about “doing what is right”.  “The General Assembly has never uttered a word in any resolution about Hamas,” she said.  The decision to adopt the text by a two‑thirds majority is based on a desire to have the resolution fail.  She urged all States to vote against the motion.
The Assembly then voted to apply the two‑thirds majority requirement by a very narrow simple majority margin of 75 in favour, 72 against, with 26 abstentions.

Those favouring a two-thirds majority vote included 44 out of 56 Islamic States – whilst one (Albania) voted against, 5 abstained and 6 did not vote.

Non-Islamic States supporting the Islamic States bloc included: Argentina, Bolivia, Brazil, China, Cuba, Ecuador, El Salvador, Ethiopia, Guatemala, Japan, Nicaragua, Russia, South Africa, Thailand, Venezuela, and Vietnam.

All 21 member States of the European Union supported America’s simple majority stance.

Others backing America included: Australia, Bosnia, Canada, Colombia, Estonia, Ghana, Honduras, India, Israel, Latvia, Lithuania, Malawi, Mexico, Paraguay, Peru, South Korea, Singapore, Slovakia, Ukraine and Uruguay.

L 42 was then passed by the UNGA by 87 votes for, 57 against and 33 abstentions – but was declared lost because it had not secured the two-thirds majority required.
The Islamic States had secured a three-vote procedural victory – setting a precedent that is bound to be attempted again.

Hamas and other militant groups remain free to engage in heinous conduct found worthy of UN condemnation by a majority of UN member states.

The foundational basis of the UN – maintaining international peace and security – has been flagrantly circumvented by the UNGA failing to agree on how to run its own meetings.

Such is the depth of total irrelevance to which the UN has sunk.

David Singer: Trump Should Reject PLO and UN Propaganda on East Jerusalem

Here's the latest post by Sydney lawyer and international affairs analyst David Singer.

He writes:

President Trump’s as-yet unannounced “ultimate deal”  to resolve the Arab-Jewish conflict has received a setback following Saudi Arabia’s King Salman reassuring Palestine Liberation Organisation (PLO) Chairman Mahmoud Abbas that Saudi Arabia would oppose any Trump peace plan that did not accept the PLO stance on East Jerusalem becoming the capital of an independent Palestinian Arab state.

The PLO claim to East Jerusalem is based on its own propaganda and that of the United Nations which claims East Jerusalem to be “occupied territory”.

United Nations Security Council Resolution 2334 – adopted on 23 December 2016 – expresses this claim in the following terms:
 “1. Reaffirms that the establishment by Israel of settlements in the Palestinian territory occupied since 1967, including East Jerusalem, has no legal validity and constitutes a flagrant violation under international law and a major obstacle to the achievement of the two-State solution and a just, lasting and comprehensive peace;
   2. Reiterates its demand that Israel immediately and completely cease all settlement activities in the occupied Palestinian territory, including East Jerusalem, and that it fully respect all of its legal obligations in this regard”
These clauses are flawed – denying Jewish claims in East Jerusalem and lacking legitimacy for the following reasons:
- East Jerusalem is not “Palestinian territory”. Jews had lived there for 3000 years until every Jewish inhabitant was forcibly expelled in 1948 by six invading Arab armies.
- East Jerusalem is “reoccupied territory” – not “occupied territory” – having been reclaimed by the Jewish people in the 1967 Six Day War from Jordanian occupation that had made East Jerusalem Judenrein for 19 years.
 - The legal right to reconstitute the Jewish National Home in East Jerusalem was unanimously affirmed by all 51 member states of the League of Nations under article 6 of the 1922 Mandate for Palestine and preserved by article 80 of the UN Charter.
 - Jews are the only people to have ever had a capital in Jerusalem:
“Jerusalem has stood at the center of the Jewish people’s national and spiritual life since King David made it the capital of his kingdom in 1003 BCE. The city remained the capital of the Davidic dynasty for 400 years, until the kingdom was conquered by the Babylonians. Following the return from the Babylonian exile in 538 BCE, Jerusalem again served as the capital of the Jewish people in its land for the next five and a half centuries.”
- The Palestinian Arabs failed to establish an independent state with East Jerusalem as its capital between 1948 and 1967 – choosing instead unity with Transjordan to create a new sovereign entity called “Jordan”
- The PLO on its formation in 1964 expressly rejected any claim to sovereignty in East Jerusalem.
The terms “occupied territory” and “occupied Palestinian territories” have been used to beat Israel over the head for decades. They are false and misleading.

“Reoccupied territory” and “reoccupied Jewish territories” posit an entirely different mindset.

US Ambassador to the United Nations Nikki Haley has made Trump’s intentions very clear:
“From now on, every country knows that the United States will not just block anti-Israel measures, we will shine a light on those who are responsible. There won’t be any more free passes for those who bully Israel at the UN”
Trump should reject these fictitious PLO and UN propaganda ploys to remind King Salman of the speciousness of PLO claims to East Jerusalem.

King Salman told Abbas:
“We accept what you accept and we reject what you reject”
Blind submission to PLO dictates is not the way to confront President Trump.

Semantics are important. One word – “reoccupied” instead of “occupied” – makes a world of difference.

David Singer: Macron, Merkel and May Should Adopt Trump Policy on Jerusalem

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

The opening of the American Embassy on 14 May in Israel’s capital – Jerusalem – should be replicated by fellow-democracies France, Germany and The United Kingdom (“the Democratic Trio”) without delay.

President Trump’s policy on Jerusalem was set out by him on 6 December 2017 (“the Trump Declaration”):
“STATUS OF JERUSALEM: President Trump recognises that specific boundaries of sovereignty in Jerusalem is highly sensitive and subject to final status negotiations.
President Trump recognises that the status of Jerusalem is a highly sensitive issue, but he does not think the peace process is aided by ignoring the simple truth that Jerusalem is home to Israel’s legislature, supreme court, President, and Prime Minister.
President Trump recognises that the specific boundaries of Israeli sovereignty in Jerusalem are subject to final status negotiations between the parties.
President Trump reaffirms United States support for the status quo at the Temple Mount, also known as Haram al Sharif.”
This policy should be perfectly acceptable to the Democratic Trio – yet they have so far baulked at following Trump’s principled stance.

French President Emmanuel Macron has adopted the following position:
“The status of Jerusalem is a question of international security that concerns the entire international community. The status of Jerusalem must be determined by Israelis and Palestinians in the framework of negotiations under the auspices of the United Nations”
Waiting for these stars to align is like hoping to win the lottery.The Trump Declaration provides sufficient guarantees to ensure that should Macron’s wish-list ever eventuate – the United Nations will be sufficiently seized of the situation to ensure the status of Jerusalem is finally determined between Arabs and Jews.

Refusing to move the French Embassy to Israel’s designated capital now – whilst negotiations to determine Jerusalem’s future have been suspended by the Palestine Liberation Organisation since April 2014 – is bowing to the dictates and diplomatic blackmail of an illegal and undemocratic entity.

France – a bastion of democracy – is being incredibly naïve in not following in the footsteps of the Trump Declaration.

German Chancellor Angela Merkel has issued a public statement assuring Germany will not relocate its embassy from Tel Aviv to Jerusalem:
“We have to work for the two-state solution, and according to that, the status of Jerusalem should be clarified.”
The “two-state solution” has been the subject of unsuccessful negotiations for the last 25 years.

East Jerusalem was never suggested or declared as the capital of Jordan or another independent Arab state during the years between 1948 and 1967 when East Jerusalem was:
Illegally occupied by Jordan;
All Jews living there were forcibly expelled from their homes;
Centuries-old synagogues and Jewish cemeteries were desecrated and destroyed;
Jews were denied access to their remaining holy sites
Merkel needs to reject this dark period in Jerusalem’s history by adopting the reality expressed in the Trump Declaration.

Britain’s prime minister Theresa May has stated:
“We disagree with the US decision to move its embassy to Jerusalem and recognise Jerusalem as the Israeli capital before a final status agreement. The British Embassy to Israel is based in Tel Aviv, and we have no plans to move”
Moving the United Kingdom’s Embassy to West Jerusalem on the identical basis enunciated by Trump will not prejudice future negotiations between Jews and Arabs to resolve East  Jerusalem’s final status.

France, Germany and the United Kingdom need to get on the Trump bandwagon and move their Embassies to Israel’s declared capital – Jerusalem –  following  their own worldwide well-established diplomatic practices and precedents.

Disagreements between democracies play into the hands of unelected and unaccountable regimes.Bowing to these regimes’ unjust and unreasonable demands is a sure-fire recipe for disaster.

David Singer: Trump Credits Senate Bipartisanship for Jerusalem Declaration

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

President Trump’s State of the Union address was mainly met in stony silence by the Democrats as their Republican rivals continually jumped to their feet to loudly applaud the President’s many achievements at home and overseas during the past twelve months.

Sustained Republican applause greeted Trump’s statement:
“Last month, I also took an action endorsed unanimously by the U.S. Senate just months before. I recognized Jerusalem as the capital of Israel.”
Yet the Democrats chose not to stand and applaud this special moment that was theirs as much as the Republicans, President Trump unreservedly acknowledging the Senate’s pivotal role in his historic Jerusalem Declaration.

Senate Resolution S.Res.176 – passed on 5 June 2017 by 90 votes to 0 – had declared:
“RESOLUTION
Commemorating the 50th anniversary of the reunification of Jerusalem.
Whereas June 2017 marks the 50th anniversary of the Six Day War and the reunification of the city of Jerusalem;
Whereas there has been a continuous Jewish presence in Jerusalem for 3 millennia;
Whereas Jerusalem is a holy city and the home for people of the Jewish, Muslim, and Christian faiths;
Whereas, for 3,000 years, Jerusalem has been Judaism's holiest city and the focal point of Jewish religious devotion;
Whereas, from 1948 to 1967, Jerusalem was a divided city, and Israeli citizens of all faiths as well as Jews of all nationalities were denied access to holy sites in eastern Jerusalem, including the Old City, in which the Western Wall is located;
Whereas, in 1967, Jerusalem was reunited by Israel during the conflict known as the Six Day War;
Whereas, since 1967, Jerusalem has been a united city, and persons of all religious faiths have access to holy sites within the city;
Whereas this year marks the 50th year that Jerusalem has been administered as a united city in which the rights of all faiths have been respected and protected; Whereas the Jerusalem Embassy Act of 1995 (Public Law 104–45), which became law on November 8, 1995, states that Jerusalem should remain the undivided capital of Israel in which the rights of every ethnic and religious group are protected; and
Whereas it is the longstanding policy of the United States Government that a just resolution to the Israeli-Palestinian conflict can only be achieved through direct, bilateral negotiations without preconditions for a sustainable two-state solution: Now, therefore, be it
 Resolved, That the Senate –
(1) recognizes the 50th Anniversary of the reunification of Jerusalem and extends its friendship and hopes for peace to the residents of Jerusalem and the people of Israel;
(2) reaffirms its support for Israel’s commitment to religious freedom and administration of holy sites in Jerusalem;
(3) continues to support strengthening the mutually beneficial American-Israeli relationship;
(4) commends Egypt and Jordan, former combatant states of the Six Day War, who in subsequent years embraced a vision of peace and coexistence with Israel and have continued to uphold their respective peace agreements;
(5) reaffirms that it is the longstanding, bipartisan policy of the United States Government that the permanent status of Jerusalem remains a matter to be decided between the parties through final status negotiations towards a two-state solution; and (6) reaffirms the Jerusalem Embassy Act of 1995 (Public Law 104–45) as United States law, and calls upon the President and all United States officials to abide by its provisions.
Republicans and Democrats had come together to draft and unanimously endorse this historic resolution – which had clearly inspired President Trump’s Jerusalem Declaration. Such bipartisanship has now seemingly disappeared with the release of the Nunes Memo

David Singer: Israel-Jordan Negotiations Could Follow PLO Threat to Boycott Trump

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

The Palestine Liberation Organisation (PLO) threat to refuse to negotiate with Israel unless President Trump withdraws his recognition of Jerusalem as the capital of Israel could see Jordan replacing the PLO as Israel’s negotiating partner to end the 100 years-old Arab-Jewish conflict.

This threat – unless unconditionally revoked – would give Trump the opportunity to consign the PLO to the political wilderness by inviting Jordan to step in and negotiate with Israel over Trump’s eagerly-anticipated “ultimate deal”.

Jordan-Israel negotiations would offer Jordan the opportunity to recover a substantial part of Judea and Samaria (“West Bank”) annexed by Jordan in 1950 – albeit illegally – but subsequently lost to Israel in the 1967 Six Day War (“disputed territory”).

Should Jordan buck at entering into such negotiations – some 60% of the disputed territory – under Israel’s full administrative and security control since the 1995 Oslo Accords and containing just 5% of the West Bank’s entire Arab population (“Area C”) – could be annexed by Israel.

PLO-Israel negotiations over the last twenty-five years – with United Nations, UNESCO and European Union backing – aimed at creating a 22nd Arab state in the disputed territory for the first time ever in recorded history – have failed abysmally.

Such a State was an artificially-contrived creation that could never be justified on historic, geographic or demographic grounds. It had actually been rejected by successive Arab leaderships on many occasions since first being proposed by the 1937 Peel Commission.

Joint 1994 Nobel Peace Prize winners – Israeli leaders Shimon Peres and Yitzchak Rabin and PLO Chairman Yasser Arafat – all understood Jordan’s pivotal role in ending the Jewish-Arab conflict:
1. Jordan is the major part (78%) of the Palestinian Arabs’ homeland according to article 2 of the PLO Charter.
Farouk Kadoumi - Head of the Political Department of the PLO – reinforced this reality  – telling Newsweek on 14 March 1977:
 “Jordanians and Palestinians are considered by the PLO as one people.”
2.      Peres declared on 31 August 1978:
“Jordan is also Palestine… I’m against two Arab countries and against another Palestinian country, against an Arafat state. Today 50 percent of the inhabitants of Jordan are Palestinians and that is the Palestinian state…"
Peres backed this up – telling the Jewish Telegraph on April 19, 1991:
“It is not obstinacy to regard the populations of Jordan, the West Bank and Gaza as having greater similarities than differences. The Jordan River is not deep enough to turn into a knife blade serving to cut one piece of territory into three slices. Most of Jordan’s population are Palestinians: the residents of the West Bank are Jordanian citizens and Jordan has distributed tens of thousands of passports to residents in the Gaza Strip. Jordan is therefore an existing State. It has an army. There is therefore no need to set up another State, another army."
3.      Yitzchak Rabin told The Australian newspaper on May 27, 1985:
“One tiny State between Israel and Jordan will solve nothing. It will be a time bomb.”
     Rabin’s solution to end the conflict:
“… the Palestinians should have a sovereign State which includes most of the Palestinians. It should be Jordan with a considerable part of the West Bank and Gaza. East of the Jordan River there is enough room to settle the Palestinian refugees.”
Jordan-Israel negotiations on the political future of the disputed territory open up options to resolve the Arab-Jewish conflict never before considered. If Trump’s Jerusalem Declaration helps bring such negotiations about – then Trump could well succeed where all other American presidents before him have failed.

Taking on Trump could herald the PLO’s political demise after 54 years of failed leadership.

David Singer: UN Vote on Trump’s Jerusalem Decision Reaches New Legal Low

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

The United Nations General Assembly resolution on 21 December 2017 asking nations not to establish diplomatic missions in Jerusalem (“Resolution”) was adopted by 128 of the 193 member States acting in breach of three specific articles in the UN Charter.
1. Article 2(7):
“Nothing contained in the present Charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state or shall require the Members to submit such matters to settlement under the present Charter; but this principle shall not prejudice the application of enforcement measures under Chapter Vll.”
President Trump’s decisions to recognise Jerusalem as Israel’s capital and move the US Embassy from Tel Aviv to Jerusalem were made in accordance with the Jerusalem Embassy Act passed on 24 October 1995 by the Senate 93:5 and the House 374:37.
Trump’s decisions fell squarely within the framework of America’s domestic jurisdiction.
Other countries wanting to follow America by locating their Embassies in Jerusalem are perfectly entitled to do so free of UN condemnation or interference.
2. Article 12(1):
“While the Security Council is exercising in respect of any dispute or situation the functions assigned to it in the present Charter, the General Assembly shall not make any recommendation with regard to that dispute or situation unless the Security Council so requests.”
The Security Council had considered the situation brought about by President Trump’s decisions three days prior to the General Assembly meeting – when a draft UN Security Council resolution rejecting US policy shift on Jerusalem was vetoed by the United States.
The General Assembly was not empowered to make any recommendations whilst the Security Council remained seized of the issue - unless the Security Council requested the General Assembly to so act – which was not the case.
The General Assembly’s Resolution was passed in breach of Article 12(1).
3. Article 80(1):
“… nothing in this Chapter shall be construed in or of itself to alter in any manner the rights whatsoever of any states or any peoples or the terms of existing international instruments to which Members of the United Nations may respectively be parties."
This article preserves the legal right of the Jewish people to reconstitute the Jewish National Home in Jerusalem in accordance with the Mandate for Palestine – unanimously endorsed by all 51 member States of the League of Nations in 1922.
 50 of those League of Nations member States are members of the United Nations and voted on the Resolution as follows:
(i) 11 abstained:
Argentina, Australia, Canada, Colombia, Czech Republic, Haiti, Latvia, Panama, Paraguay, Poland and Romania
(ii) 1 did not vote:
El Salvador
(iii) 2 Voted against the Resolution:
Guatemala and Honduras
(iv) 36 voted for the Resolution:
Albania, Austria, Belgium, Bolivia, Brazil, Bulgaria, Chile, China, Costa Rica, Cuba, Denmark, Estonia, Finland, France, Greece, India, Iran, Italy, Japan, Liberia, Lithuania, Luxembourg, Netherlands, New Zealand, Nicaragua, Norway, Peru, Portugal, South Africa, Spain, Sweden, Switzerland, Thailand, Uruguay, United Kingdom, Venezuela
The votes of these 36 States delimited the legal rights of the Jewish people that their very own respective countries had been instrumental in creating in 1922.
The other 92 member states who voted for the Resolution also apparently had no qualms in ignoring article 80(1).
Trump was clearly not happy with the UN’s intrusion into America’s domestic affairs - immediately cutting $285 million from America’s proposed 2018 UN Budget with more financial cuts likely to occur.

UN member States reached a new legal low engaging in cavalier conduct involving flagrant breaches of the UN Charter.

The UN slide into irrelevancy continues to gather momentum.

David Singer: UN, OIC, EU and PLO invite Trump Retaliation

For this and related antisemitic cartoons click here
Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

Humiliating President Trump by declaring his decision recognising Jerusalem as the capital of Israel as being “null and void and must be rescinded” – spells financial and political trouble for the United Nations (UN), the Organisation of Islamic Cooperation (OIC), the European Union (EU) and the Palestine Liberation Organisation (PLO).

The timing of Trump’s decision can certainly be criticised – but questioning Trump’s sovereign right to make that decision constitutes a flagrant attempt to undermine the offices of the democratically-elected US President and Congress. Trump’s decision was made in accordance with international law and American domestic law – making a mockery of those who have claimed otherwise.

The first two casualties of this unprecedented political and legal attack on America’s governing institutions could be:
1. the United Nations Relief and Works Agency for Palestinian Refugees (“UNRWA”) and
2. the two-state solution proposed by the 1993 Oslo Accords and President Bush’s 2003 Roadmap – as endorsed by the UN, the EU and Russia (“two-state solution”)
US Ambassador to the UN – Nikki Haley – put UNWRA clearly in President Trump’s sights for retaliatory action when she declared:
“The United States has done more than any other country to assist the Palestinian people. By far. Since 1994, we have given over $5 billion to the Palestinians in bilateral economic assistance, security assistance, and humanitarian assistance.
The United Nations Relief and Works Agency for Palestinian Refugees operates schools and medical facilities throughout the region. It is funded almost entirely by voluntary contributions. Last year, the United States voluntarily funded almost 30 percent of UNRWA’s budget. That’s more than the next two largest donors combined. And it’s vastly more than some of the members of this Council that have considerable financial resources of their own.
I’ll be blunt: When the American people see a group of countries whose total contributions to the Palestinian people is less than one percent of UNRWA’s budget – when they see these countries accuse the United States of being insufficiently committed to peace – the American people lose their patience.”
UNRWA is facing the grim prospect of having to find up to US$400 million annually from other UN member States if Trump cuts America’s current voluntary contribution to UNWRA.

President Trump has already announced America will withdraw from UNESCO in 2018 – attributed in part to “anti-Israel bias” – which will require another US$143 million – 22% of UNESCO’s annual budget – to be found from other member states.

Biting the hand that feeds you does have consequences.

The catastrophic decisions made by the UN, OIC, EU and PLO over the past two weeks following Trump’s Jerusalem Declaration could seriously impact any “ultimate deal” Trump has been putting together to end the Jewish-Arab conflict.

The two-state solution – which envisages a second (democratic) Arab state – in addition to (undemocratic) Jordan – on the land comprised in the 1922 Mandate for Palestine – remains in limbo since the suspension of negotiations between Israel and the PLO in April 2014.

Trump can now justifiably jettison the two state solution – including Abbas and the PLO – from his ultimate deal – after Abbas defiantly declared on 22 December:
"The United States has proven to be a dishonest mediator in the peace process and we will no longer accept any plan from the United States"
Abbas’s outburst has effectively consigned the two-state solution to the dustbin of history.

Abbas has once again demonstrated the unerring ability of the Palestinian Arabs to snatch defeat from the jaws of victory – as happened in 1922, 1937, 1947, between 1948 and 1967, 2000/20001 and 2008.

Trump’s ultimate deal must now be seriously struggling to see the light of day.

David Singer: OIC in Legal Fantasyland over Trump, Jerusalem and Israel

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

He writes:

The 57 member States of the Organisation of Islamic Cooperation (OIC) are living in a legal fantasyland of their own creation where non-existent principles of international law supposedly apply.

The final communique issued by the OIC following its Extraordinary Summit held in Turkey on 13 December 2017 makes their flight into legal unreality crystal-clear:
1. OIC members pledged to take joint action on the basis of international law against the statement of President Trump recognising Jerusalem as Israel’s capital.
Yet international law unreservedly recognises the sovereign right of each State to designate its capital and the sovereign right of other States to decide whether to recognise that State and to locate their Embassies in such capital.
The Jerusalem Embassy Act 1995 passed overwhelmingly by the United States Congress recognized and affirmed these long-established legal principles:
“Each sovereign nation, under international law and custom, may designate its own capital…
… Since 1950, the city of Jerusalem has been the capital of the State of Israel.
… The United States maintains its embassy in the functioning capital of every country except in the case of our democratic friend and strategic ally, the State of Israel.”
2. The OIC condemned the illegal settlement activities by Israel in the occupied Palestinian territories.
The “occupied Palestinian territories” are in fact “disputed territories” in international law where competing Jewish and Arab claims to sovereignty remain to be resolved.
No binding legal ruling exists to substantiate the OIC’s mendacious claim.
There is however territory-specific legislation that negates this OIC claim – namely article 6 of the Mandate for Palestine and article 80 of the United Nations Charter.
3. The OIC declared President Trump’s statement to be “null and void”.
The OIC acting as judge, jury and Lord High Executioner has deigned to tell an American President he cannot act in accordance with international law.
Dismissing international law by claiming it to be “null and void” has also been adopted by the Palestine Liberation Organization - whose Charter proclaimed that two cardinal planks in international law – the Balfour Declaration and the Mandate for Palestine and all that had been based on them were:
· “considered fraud” in 1964 (article 18) and
· “deemed null and void” in 1968 (article 20)
The fictitious “State of Palestine” is among the 22 Arab States that are OIC members.

The Jewish-Arab conflict remains unresolved because the Arabs have never accepted the binding validity in international law of the Mandate for Palestine unanimously endorsed by all 51 then-member States of the League of Nations in 1922:
Albania, Argentina, Australia, Austria, Belgium, Bolivia, Brazil, British India, Bulgaria, Canada, Chile, Colombia, Costa Rica, Cuba, Czechoslovakia, Denmark, El Salvador, Estonia, Finland, France, Greece, Guatemala, Haiti, Honduras, Italy, Japan, Kingdom of Serbs, Croats, and Slovenes, Latvia, Liberia, Lithuania, Luxembourg, Netherlands, New Zealand, Nicaragua, Norway, Panama, Paraguay, Persia, Peru, Poland, Portugal, Republic of China, Romania, Siam, Spain, Sweden, Switzerland, Union of South Africa, United Kingdom, Uruguay, and Venezuela.
Many of these countries have chosen in 2017 to disregard their own decisions in 1922 which established the framework for two States – one Jewish, one Arab – being eventually created in Palestine.

Today sovereignty in 95% of the territory comprised in the Mandate for Palestine resides in those two States – Israel (17%) and Jordan (78%).

Resolving the Jewish-Arab conflict will become realistically attainable when the OIC:
1. affirms that the Mandate for Palestine is legally binding in international law and
2. recognizes the State of Israel
Cherry-picking bits and pieces of International law or even worse – making it up and refusing to acknowledge its falsity – is a recipe for continuing chaos and disorder.

Jerusalem: Views from the Far North

Image credit: Reuters
What an utter disastrous mess is Sweden, whose repellent foreign minister,  Margot Wallström,  recently declared:
“It is deeply regrettable that the United States will stop people from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen from entering the country,given the incendiary and aggressive nature of Trump’s new immigration ban,we want to ban Israelis from entering our country.
 Israel has been extremely aggressive. … They have continued with their settlement policies, they have continued demolitions, they have continued their occupation policies which entail a humiliation of Palestinians, which makes the process difficult”.
A land whose self-destructive leftism is well represented by this poster girl for the eradication of Israel, another of those whacko "feminist" socialist member of parliament who are so gladly contributing to the death-by-demography of their own national heritage and its values.

A land in which population replacers cultural enrichers are turning entire districts into no-go zones and hellholes and are endangering the safety of women and Jews.

A land which, having such a small indigenous population to begin with, may well end up as the first European Islamic republic.

Just take a look at these ferocious types in Sweden's third largest city, Malmö, on Friday demonstrating in bloodcurdling antisemitic terms their displeasure at Donald Trump's recognition of Jerusalem as Israel's capital. ("We've declared an intifada in Malmö .... We will shoot Jews" and so on):

The BBC and most of the mainstreammedia gave the firebombing of a synagogue in Gothenburg on Saturday little publicity, perhaps because no one was physically injured. But the incident has left scars.

To quote, inter alia, Ynetnews:
'A group of 21 people with covered faces threw Molotov cocktails Saturday at a synagogue in Gothenburg.... No one was hurt in the incident, but a small fire broke out in the synagogue's parking lot. "I saw a ball of fire," one eye witness recounted....
According to a local paper, a group of Jewish youth movement members held an activity in the synagogue's complex at the time of the attack. The mother of one of the girls participating in the activity said, "She texted me, 'Mom, I'm scared' and told me 20 men with covered faces threw burning objects at the complex."
The chairman of Gothenburg's Jewish community, who witnessed the event, recounted: "Dozens of men with masks began throwing burning objects at our courtyard."
Dvir Maoz, an emissary of the world Bnei Akiva movement to Gothenburg, said, "I popped in to say hello at a party (in the synagogue complex) and sat with one of the guards. As we were talking, I saw a ball of fire out of the corner of my eye. I jumped right into the guardroom and told him a Molotov cocktail was thrown. The children were really stressed out because it was the first time they experienced a terrorist attack so close by."
"Parents came around and took the children home. Some of them were really stressed, and one told me he felt unsafe. Another told me because he had a very recognizably Jewish name the Arabs in his school routinely swore at him, bullied him and spat on him. I still can't say we're feeling an increase in anti-Semitism in our daily lives," Maoz added....'
And to quote this young guy, a Swedish freelance journalist living in Norway:

And here is the heartfelt cry of a Swedish Jew:

David Singer: Media Falsely Discredit Trump as He Confronts UN on Jerusalem

Here's the latest article by Sydney lawyer and international affairs analyst David Singer.

(At left: a participant in Sydney's so-called "Solidarity Rally with Jerusalem to say no to the United States' recognition of Jerusalem as the capital of Israel" that took place on Saturday.  Below: a face in the crowd. Photographer: Peter Boyle for Green Left Weekly. Third image: Jews expelled from their homes in Jerusalem by Jordanian troops in 1948: Life magazine.)

Writes David Singer:

The media has discredited President Trump’s decision to recognize Jerusalem as Israel’s capital – falsely claiming the president has reversed nearly seven decades of American foreign policy. Trump’s decision has pitted America squarely against the United Nations.

The New York Times led the pack declaring:
“President Trump on Wednesday formally recognized Jerusalem as the capital of Israel, reversing nearly seven decades of American foreign policy …”
Australia’s publicly-funded national broadcaster – the ABC – followed suit with this headline:
“Donald Trump recognises Jerusalem as Israel's capital, in reversal of decades of policy”
News outlets including Reuters, Financial Times, Iraqinews, Gulfnews, and Today parroted this false claim.

America’s policy on Jerusalem is actually laid out in “The Jerusalem Embassy Act 1995 (Act)” passed by the Senate (93–5) and the House (374–37) on 24 October 1995 – specifically highlighted by Trump when announcing his decision:
“In 1995, Congress adopted the Jerusalem Embassy Act, urging the federal government to relocate the American embassy to Jerusalem and to recognize that that city -- and so importantly -- is Israel’s capital. This act passed Congress by an overwhelming bipartisan majority and was reaffirmed by a unanimous vote of the Senate only six months ago.”
The Act unequivocally states:
“SEC. 3. TIMETABLE.
(a) Statement of the Policy of the United States.
(1) Jerusalem should remain an undivided city in which the rights of every ethnic and religious group are protected. (2) Jerusalem should be recognized as the capital of the State of Israel; and (3) the United States Embassy in Israel should be established in Jerusalem no later than May 31, 1999.”
The Act’s preamble details the following facts critical to Congress’s overwhelming vote:
1. Each sovereign nation, under international law and custom, may designate its own capital.
 2. Since 1950, the city of Jerusalem has been the capital of the State of Israel.
 3. The city of Jerusalem is the seat of Israel´s President, Parliament, and Supreme Court, and the site of numerous government ministries and social and cultural institutions.
4. The city of Jerusalem is the spiritual center of Judaism, and is also considered a holy city by the members of other religious faiths.
5. From 1948-1967, Jerusalem was a divided city and Israeli citizens of all faiths as well as Jewish citizens of all states were denied access to holy sites in the area controlled by Jordan.
6. In 1967, the city of Jerusalem was reunited during the conflict known as the Six Day War.
7. Since 1967, Jerusalem has been a united city administered by Israel, and persons of all religious faiths have been guaranteed full access to holy sites within the city.
8. The United States maintains its embassy in the functioning capital of every country except in the case of our democratic friend and strategic ally, the State of Israel.
9. In 1996, the State of Israel will celebrate the 3,000th anniversary of the Jewish presence in Jerusalem since King David´s entry.
The morally-bankrupt United Nations has ignored these facts for the last 22 years – choosing instead to pass countless resolutions supporting spurious Arab claims to East Jerusalem that could have been satisfied at any time between 1948 and 1967 following six Arab armies illegally invading Western Palestine and ethnically cleansing East Jerusalem’s entire Jewish population, destroying synagogues and desecrating Jewish cemeteries.

United Nations member States who vote – or abstain from voting – on future resolutions supporting specious artificially-contrived Arab claims in East Jerusalem risk being collectively shamed and internationally castigated.

The media’s latest myth remains unretracted and uncorrected. Trump’s principled decision follows United States policy adopted since 1995.

God bless America.
